On November 8th, Michigan passed Proposal 3, enshrining the right to abortion in our constitution.
Proposal 3 sponsors claimed it would only invalidate the 1931 abortion law. But the language of this amendment goes far beyond “restoring Roe v. Wade” and could drastically alter dozens of state laws. It fundamentally changes the relationship between parents and their children, eliminating parental rights, allowing for full-term abortions, eliminating informed consent and making the tax-payers bear the cost (to name only a few repercussions).

What does the amendment do?

“Constitutional Amendment to: establish new individual right to reproductive freedom, including right to make and carry out all decisions about pregnancy, such as prenatal care, childbirth, postpartum care, contraception, sterilization, abortion, miscarriage management, and infertility; allow state to prohibit abortion after fetal viability unless needed to protect a patient’s life or physical or mental health: forbid state discrimination in enforcement of this right; prohibit prosecution of an individual, or a person helping a pregnant individual, for exercising rights established by this amendment; and invalidate all state laws that conflict with this amendment.”
If it seems confusing, that’s because it is!
It says it invalidates all laws that conflict with this constitutional amendment. But the proposal doesn’t tell you which laws. You have to guess that yourself! We think there might be around 40 laws repealed.
Which laws are repealed by this amendment?
Proposal 3 could affect:
- The 1931 law that protects unborn life.
- The law requiring parental consent for abortion. Teenage girls could get an abortion without any parent even knowing.
- The laws banning late-term and partial-birth abortions.
- The law that only doctors can perform abortions.
- The law that ensures babies born alive during abortion procedures are protected and cared for.
- The prohibition on chemical poisons that take unborn life.
